Terms of Use

1. The service

Earmonic provides interactive listening lessons, generated practice, progress estimates, personal goals, optional hardware calibration, and related educational tools. Listening scores and mastery estimates are learning aids, not professional certification or a guarantee of musical performance.

2. Eligibility and responsible use

You must be legally able to agree to these terms. If you are under the age of legal majority where you live, a parent or guardian must approve downloads, optional account connection, and purchases. Do not use the App where listening or interacting with a device would be unsafe, and protect your hearing by using a comfortable volume.

3. License

Subject to these terms, Earmonic Games Ltd grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on supported devices for personal, non-commercial music learning. You may not copy, sell, sublicense, distribute, reverse engineer, bypass access controls, interfere with the App, or use its content to build a competing dataset or service except where applicable law expressly permits.

4. Local progress and optional sync

Core progress is local-first. You are responsible for maintaining access to your device and any device backups. Optional Google Drive sync is provided for convenience and may be unavailable, delayed, disconnected, or affected by Google account settings. Sync combines earned progress and deduplicates recent sessions. Up to 200 recent sessions are retained, and older aggregate counts may be conservative where history is incomplete. Preferences and unfinished sessions remain local. Confirm successful backup before removing the App or clearing its storage. Review the Privacy Policybefore connecting.

5. Earmonic Pro

Earmonic may offer monthly and yearly auto-renewing subscriptions and a one-time Lifetime purchase. Each paid package unlocks the same Pro features. Subscriptions grant access for their active period; Lifetime is a one-time purchase and does not renew. Pro purchases do not include a free trial. The App remains useful without a subscription, while the current paywall identifies which features require Pro.

• The store displays the actual localized price, billing period, and taxes before purchase.
• Payment is charged to your Apple App Store or Google Play account after you confirm the purchase.
• A subscription renews automatically unless you cancel through the same store before its renewal deadline.
• Deleting the App or disconnecting Google does not cancel a subscription.
• You can restore eligible purchases from the App. Store account, country, family-sharing, and platform rules may affect restoration.
• Cancellations, refunds, billing disputes, and charge reversals are handled under the store's rules and applicable law.

6. Price or service changes

We may improve, add, remove, or reorganize App features and may change future subscription prices for valid business, product, legal, or market reasons. Store-controlled notice, consent, and cancellation rights apply to price changes. We will not represent a one-time benefit as an ongoing subscription and will aim to provide sustained value while a subscription is active.

7. Imports, challenge codes, and feedback

The App may let you import teacher programs or share challenge recipes. Do not import or share unlawful, malicious, infringing, or deceptive material. Challenge codes should describe practice recipes and must not be used to expose another person's learning history or personal information. Feedback you send is voluntary; we may use general feedback to improve Earmonic without an obligation to compensate you.

8. Intellectual property

The App, website, brand, original curriculum structure, generated exercise systems, text, interface, graphics, and other materials are owned by or licensed to Earmonic Games Ltd and protected by applicable law. These terms do not transfer ownership to you. Third-party platform names and services remain the property of their respective owners.

9. Availability and third-party services

Device audio, microphones, MIDI hardware, Bluetooth, Google Drive, RevenueCat, and app stores may fail or become unavailable. The App is designed to recover where practical, but we do not guarantee uninterrupted operation, compatibility with every device, or permanent availability of any third-party service. Their own terms govern your use of those services.

10. Disclaimers and liability

The App is provided “as is” and “as available.” To the fullest extent permitted by law, Earmonic Games Ltd disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or punitive losses arising from the App. Nothing in these terms excludes consumer rights or liability that cannot legally be excluded or limited.

11. Suspension and termination

You may stop using the App at any time. We may suspend access to a service component if reasonably necessary for security, legal compliance, fraud prevention, or serious misuse. Store subscription cancellation remains governed by the store and is not completed merely by uninstalling the App.

12. Store-specific terms

On Apple platforms, Apple's standard end-user license agreement applies unless a valid custom EULA is presented in the applicable storefront; these terms supplement it. On Google Play, the Google Play Terms of Service and applicable Play policies also apply. If a store rule conflicts with these terms for a store-distributed copy, the mandatory store rule controls to the extent of that conflict.

13. Changes, disputes, and contact

We may update these terms when the App, subscriptions, providers, or legal requirements change. The date above identifies the current version. Mandatory local consumer law continues to apply. Before starting a formal dispute, please contact support@earmonic.com so we can try to resolve the issue.
